1. Introduction and Acceptance
These Terms of Service ("Terms") govern your access to and use of Lewsearch, a synthetic AI market research platform operated by Swarmgram, Inc., a Delaware corporation doing business as Lewsearch ("Swarmgram, Inc. DBA Lewsearch," "Company," "we," "us," or "our"). By creating an account or using any Lewsearch service, API, or interface, you agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the service. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization.
2. Description of Service
Lewsearch provides AI-generated synthetic panel research. Study results are produced by large language models ("LLMs") that have been fine-tuned and calibrated against published survey data from sources including Pew Research, Gallup, the University of Texas / Texas Politics Project, the Public Policy Institute of California (PPIC), and official election results. All outputs are statistical approximations of public opinion based on demographic priors. They are not collected from live human respondents. Results are intended for directional research, strategic planning, marketing insight, and concept testing. Lewsearch results should not be used as a substitute for probabilistic sampling in legal, regulatory, clinical, journalistic, or electoral contexts without appropriate disclosure and expert review.
3. Eligibility and Accounts
You must be at least 18 years of age and legally authorized to enter a binding contract. You agree to provide accurate, current, and complete registration information. You are responsible for all activity occurring under your account. You must notify us immediately at jeffrey@lewsearch.com upon discovering unauthorized account access. We reserve the right to suspend accounts that we reasonably believe have been compromised or are being used in violation of these Terms. Account credentials may not be shared, transferred, or sold to third parties.
4. Proprietary Technology and Intellectual Property
Swarmgram, Inc. DBA Lewsearch retains exclusive ownership of all right, title, and interest in: (a) the Lewsearch platform and all application software; (b) the underlying AI models, model weights, training pipelines, inference configurations, and all associated technical components; (c) the proprietary methodology used to simulate, calibrate, and update synthetic agent behavior, including all algorithms, weighting systems, and data enrichment processes; (d) the synthetic agent population, including all profile data, behavioral priors, and accumulated state; (e) benchmark methodology, calibration datasets, and accuracy validation frameworks; (f) the Lewsearch and Swarmgram names, logos, and trademarks. Nothing in these Terms grants you any license to the foregoing except the limited right to use the service as described herein.
5. Prohibition on Reverse Engineering and Competitive Use
You may not, directly or indirectly, and you may not permit any third party to: (a) reverse engineer, decompile, disassemble, or otherwise attempt to reconstruct, identify, or derive the source code, model weights, training data composition, calibration methodology, or architectural parameters of any Lewsearch, Swarmgram, lewn, or Lewis model or service component; (b) systematically query the API or interface in a manner designed to infer model structure, training data, or calibration techniques; (c) scrape, crawl, or bulk-extract study outputs, API responses, or benchmark results for the purpose of training, fine-tuning, distilling, or validating any AI model that competes with Lewsearch; (d) probe or test system security, attempt authentication bypass, or conduct any form of penetration testing without written authorization; (e) publish comparative benchmarks between Lewsearch and third-party services without our prior written consent; (f) use any Lewsearch, lewn, or Lewis output — including chat responses, study outputs, distributions, or generated text — as training data for, or to distill, fine-tune, or otherwise create or improve, any AI model or dataset without our prior written consent (NO DISTILLATION); or (g) build a competing product or service using insights, techniques, or patterns derived from Lewsearch, lewn, or Lewis outputs or documentation. These restrictions are material terms. Violation may result in immediate termination and legal action.
6. Customer Data and Output Ownership
You retain ownership of the questions, prompts, and inputs you submit to Lewsearch ("Customer Inputs") and the study reports generated for your account ("Customer Outputs"). You grant Swarmgram, Inc. a limited, non-exclusive, royalty-free license to process Customer Inputs solely as necessary to provide the service. For the Lewsearch enterprise service, we will not use Customer Inputs or Customer Outputs to train AI models without your explicit written consent. We may use aggregate, de-identified statistical patterns (e.g., topic frequency distributions, geographic usage patterns) for internal research and product improvement without attribution to any individual customer. You are solely responsible for how you use, interpret, and communicate Customer Outputs. (For the consumer lewn / lewn.ai chat service, model-improvement terms are described separately in Section 6A.)
6A. lewn / lewn.ai Model Improvement and Memory
This Section applies specifically to the consumer chat assistant available at lewn.ai ("lewn"). To improve the Lewis model, lewn may use your ANONYMIZED questions and the way you phrase research requests as training data. We do NOT use your study results, distributions, uploaded files, account identity, or any personal or business-identifying information for training; identifiers are stripped before any question is eligible for model improvement. This setting is ON by default and you may turn it OFF at any time in Account → Privacy & memory, after which your future questions are excluded from training. lewn also keeps a personalized "memory" of durable, non-sensitive context about you (for example, your business and the audiences you usually test) to tailor studies; you may disable memory at any time in the same settings, which also forgets what lewn has learned. Lewsearch retains exclusive ownership of the Lewis model and all weights, training pipelines, and derived improvements (see Section 4); your contribution of anonymized phrasing grants us a perpetual, irrevocable, royalty-free license to use it solely to train and improve our models and does not transfer any ownership to you.
7. Acceptable Use
You agree not to use Lewsearch to: (a) produce disinformation, fabricated public opinion, or content designed to deceive audiences about the source or nature of research findings; (b) generate content impersonating real individuals or misrepresenting AI-generated outputs as responses from live human research participants without clear disclosure; (c) influence elections, referenda, or regulatory proceedings by presenting synthetic outputs as authentic polling data without disclosure; (d) produce content that is defamatory, harassing, discriminatory, or that violates any applicable law; (e) circumvent usage limits, credit controls, or rate limits; (f) resell raw API access or operate a derivative research platform on top of Lewsearch without a written reseller agreement; or (g) use the service in any way that violates applicable local, national, or international law. When publishing or presenting Lewsearch results externally, you agree to clearly disclose that results are AI-generated synthetic panel data calibrated against published survey benchmarks.
8. Credits, Billing, and Subscriptions
Lewsearch is sold in studies. One study means one run of 500 synthetic respondents answering up to 3 questions, and internally each study is accounted for as one credit. Larger panels consume more than one study from your balance: 1,000 respondents counts as 2 credits, 2,500 as 3, 5,000 as 4, and 10,000 as 5. A pack or plan allowance described as a number of studies grants that number of credits. Credit consumption depends on respondent count, so a larger study consumes more than one study credit. A single study of 2,500 respondents consumes 3 credits and therefore the entire 3-study pack; a single study of 10,000 respondents consumes 5 credits. Message Testing panel reviews count as 1 up to 1,000 respondents, 2 at 2,500, 3 at 5,000, and 4 at 10,000; A/B mode is included at no additional cost. Focus group sessions count as 1 for panels up to 500 respondents or 2 at 1,000, with an optional 1-study participant-discussion add-on. Digital twin interviews count as 1 for panels up to 50 twins and 2 up to 100. Flash Review and Flash A/B (n=50) are included only with the Pro and Enterprise plans and, when available, do not deduct from the study balance. Flash is currently paused and requests are rejected until interactive inference is re-enabled. A new account registered with a work email receives one complimentary study credit. Study packs are one-off purchases: $149 for 3 study credits or $399 for 10 study credits. An account may purchase one pack per rolling year, measured as 365 days beginning on the date of that account's most recent pack purchase. Pack credits do not expire, are not reset when a subscription renews, and remain spendable after the subscription is cancelled, until used. The Starter plan is $595 per month, or $5,950 per year when billed annually, and includes an allowance of 20 studies per month. The Pro plan is $2,900 per month, or $29,000 per year when billed annually, and includes an allowance of 175 studies per month. The Pro plan includes five seats, provisioned on request. The Pro plan permits client deliverables and resale to up to 5 end clients, and includes your logo on exports. Unlimited resale and full white label require an Enterprise agreement. The Pro client-deliverable allowance does not authorize resale of raw API access or operation of a derivative research platform, which remain subject to Section 7(f). When billed annually, twelve months of allowance are granted at the start of the annual billing period (240 studies for Starter, 2,100 for Pro). Allowance studies included with a plan are non-transferable, reset at the start of each billing period, and do not carry over. They are distinct from purchased pack credits, which are not part of the period reset. Enterprise agreements are priced individually, start at $90,000 per year, and are governed by a separate written order form or master services agreement, which controls over these Terms where the two conflict. Concierge managed studies are priced individually and start at $999 per study. Subscriptions auto-renew for the billing period selected until cancelled. Prices may change for future billing periods with at least 30 days' notice; the price in effect when a billing period begins applies to that period. Payments are processed by Square, Inc. on our behalf. You may cancel a subscription at any time from your account billing page, and cancellation takes effect at the end of your current billing period.
9. Refunds and Cancellations
You may request a refund within 14 days of the date of your purchase. Email jeffrey@lewsearch.com with your account email and receipt. Where local consumer protection laws grant statutory withdrawal rights, those rights apply. If eligible, refunds are processed within 14 days of approval.
10. Third-Party Services
Lewsearch integrates with third-party providers including Supabase (data storage), RunPod (Lewis model inference), Square (payments), Netlify (hosting), and, on the self-serve product, certain LLM API helpers. Enterprise and dedicated deployments process study inference on a dedicated RunPod instance and do not send study content to external model APIs. Your use of these integrations is additionally governed by the respective providers' terms. Swarmgram, Inc. DBA Lewsearch is not responsible for the availability, accuracy, or conduct of third-party services. We do not store payment card information; all payment data is handled by Square under their PCI-compliant infrastructure.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED SYNTHETIC PANEL OUTPUTS ARE STATISTICAL APPROXIMATIONS AND DO NOT GUARANTEE PREDICTION OF ACTUAL HUMAN OPINION. ACCURACY BENCHMARKS PUBLISHED BY LEWSEARCH REPRESENT HISTORICAL PERFORMANCE ON SPECIFIC VALIDATION DATASETS AND DO NOT GUARANTEE EQUIVALENT PERFORMANCE ON ANY PARTICULAR QUESTION OR TOPIC. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWARMGRAM, INC. DBA LEWSEARCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) $500 USD OR (B) THE TOTAL AMOUNTS PAID BY YOU TO US IN THE THREE CALENDAR MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless Swarmgram, Inc. and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, judgments, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) your use of or access to the service; (b) your violation of these Terms or applicable law; (c) your use of Customer Outputs, including any misrepresentation of AI-generated data as human survey data; or (d) any claim by a third party that your Customer Inputs infringe or misappropriate their rights.
14. Term and Termination
These Terms remain in effect while you maintain an account. Either party may terminate at any time. We may suspend or immediately terminate your account without notice if we reasonably believe you have violated Section 5 (reverse engineering) or Section 7 (acceptable use) of these Terms, or if required to do so by law. Upon termination, your right to access the service ceases. You may request an export of your study data (subject to any active subscription) before requesting account deletion. Sections 4, 5, 6, 11, 12, 13, 14, and 15 survive termination.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Ohio without regard to conflict of laws principles. Any dispute arising from or related to these Terms or the service shall be resolved by binding arbitration in Franklin County, Ohio, under the Commercial Arbitration Rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property, proprietary technology, or confidential information. Class action proceedings and jury trials are waived to the fullest extent permitted by law.
16. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated by email to registered account holders at least 14 days before taking effect and by updating the "Last updated" date on this page. Continued use of the service after any modification constitutes acceptance of the updated Terms. If you do not agree to a material change, you may terminate your account before the change takes effect.
